The specific scope, pricing, deliverables, timelines, and service levels shall be agreed separately through quotations, service agreements, statements of work (SOW), purchase orders, or written confirmation.
3. Website Use
Users agree to use this website only for lawful purposes.

invoices are payable within the payment period stated on the invoice;
late payments may incur statutory interest and collection costs under German law;
ownership of supplied hardware remains with TechCare Systems until full payment has been received.
6. Client Responsibilities
Clients are responsible for:
providing accurate information;
granting timely access to systems and premises;
maintaining appropriate backups unless backup services have been contracted;
ensuring that licensed software used within their environment complies with applicable licensing terms.
Delays caused by missing information or unavailable access may affect project timelines.
7. Limitation of Liability
TechCare Systems shall be liable in accordance with the applicable laws of the Federal Republic of Germany.
To the extent permitted by law, TechCare Systems shall not be liable for:
indirect damages;
consequential damages;
loss of profits;
business interruption;
loss of data resulting from missing or inadequate backups maintained by the client.
Nothing in these Terms excludes liability for intent, gross negligence, injury to life, body or health, or any liability that cannot legally be excluded.
8. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights relating to:
website content;
documentation;
graphics;
branding;
logos;
templates;
software developed by TechCare Systems
remain the exclusive property of TechCare Systems or the respective rights holder.
No content may be copied, reproduced, distributed, or modified without prior written permission.
9. Data Protection
Personal data is processed in accordance with the applicable data protection laws, including the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

12. Changes to These Terms
TechCare Systems reserves the right to amend these Terms & Conditions at any time.
The latest version published on this website shall apply to future use of the website and future service engagements unless otherwise agreed contractually.
13. Governing Law
These Terms & Conditions shall be governed exclusively by the laws of the Federal Republic of Germany.
If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction shall be Essen, Germany, to the extent permitted by law.
14. Severability Clause
Should any provision of these Terms be held invalid or unenforceable, the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a legally permissible provision that most closely reflects the economic intent of the original provision.
